Democratic Party to Hold Emergency Hearing on Chief Justice Jo Hee-de

The Democratic Party passed a motion on the 22nd to adopt a plan for an emergency hearing on Chief Justice Jo Hee-de at the National Assembly’s Judiciary Committee. This follows suspicions that Chief Justice Jo intervened in the presidential election after overturning the conviction in President Lee Jae-myung’s Public Official Election Act case.

Accordingly, the hearing on Chief Justice Jo is expected to take place at 10 a.m. on the 30th. This marks the second attempt by the National Assembly to hold a hearing on the Chief Justice, following one last May when Rep. Jung Chung-rae was the Judiciary Committee chairman. At that time in May, Chief Justice Jo and others did not attend.

Democratic Party Rep. Choo Mi-ae, the Judiciary Committee chairman, said at the committee’s plenary session that day, “I, as the chairman, submitted a written motion to add to today’s agenda and first deliberate on the motion to adopt a plan for an emergency hearing related to suspicions of Chief Justice Jo Hee-de’s intervention in the presidential election and the request for witnesses and expert references to attend the hearing.”

Rep. Choo stated, “Since there are 10 committee members, including Chairman Choo Mi-ae, who have agreed to the written motion, we will proceed to a vote without debate in accordance with the National Assembly Act.” Subsequently, the plan for the hearing on Chief Justice Jo was passed with 10 votes in favor and 5 abstentions out of 15 members present. The witnesses included Chief Justice Jo, Justices Oh Kyung-mi, Lee Heung-koo, Lee Sook-yeon, and Park Young-jae, as well as former Prime Minister Han Duck-soo.

The Democratic Party has been continuously attacking Chief Justice Jo. Some lawmakers raised the unsubstantiated claim of a meeting between Chief Justice Jo and former Prime Minister Han Duck-soo. Although Chief Justice Jo denied it as “not true,” some Democratic Party lawmakers claim “there is a source.” The party leadership also stated, “Since Chief Justice Jo has been reported to the Corruption Investigation Office for High-ranking Officials over the related suspicions, we should wait and see the investigation.”

The Democratic Party also sharply criticized Chief Justice Jo’s opening remarks at the Supreme Court-hosted ‘Sejong International Conference’ held at the Shilla Hotel in Jung-gu, Seoul, that day. In his speech, Chief Justice Jo stated, “King Sejong did not use the law as a means of governance to strengthen royal authority but as a normative foundation to improve the quality of life for the people and guarantee their rights.”

Party spokesperson Kim Hyun-jung said that day, “Chief Justice Jo arrogantly spouted fallacies by saying, ‘King Sejong did not use the law as a means to strengthen royal authority,’” and added, “Chief Justice Jo Hee-de, the originator of judicial distrust, should not obstruct judicial reforms for the people.”

The People Power Party strongly protested. The party’s Judiciary Committee members held an emergency press conference, calling it “judicial destruction disguised as a hearing” and “the most serious legislative coup and criminal act that has collapsed the judiciary.” Rep. Na Kyung-won stated, “The essence of liberal democracy is to protect citizens’ human rights, and the core of the rule of law is judicial independence, yet the Democratic Party is ruthlessly destroying judicial independence.”

Rep. Na added, “The Democratic Party, which is destroying the constitutional order, is an unconstitutional party. I say that the behavior shown by the Democratic Party through today’s National Assembly Judiciary Committee meeting corresponds to an unconstitutional party subject to dissolution,” and continued, “The Democratic Party is shaking the Chief Justice with fabricated evidence (the allegation of a meeting between Jo Hee-de and Han Duck-soo). However, as it is gradually revealed that the evidence was fabricated, they are now trying to destroy the judiciary by summoning the Chief Justice under the guise of a hearing.”

Rep. Shin Dong-wook said, “Chairman Choo Mi-ae has shattered all the dignity of the National Assembly in an instant,” and added, “We can never overlook what happened in the National Assembly today.” Showing documents about summoning the Chief Justice to the National Assembly, Rep. Shin stated, “Look at the reason statement. It’s only four lines. It’s utterly shoddy—a four-line summary hastily created to summon the head of the Republic of Korea’s judiciary to the National Assembly, with their seal stamped on it in a rush.”

The reason statement for the hearing stated, “By adding to the agenda and deliberating on the motion to adopt a plan for an emergency hearing related to suspicions of Chief Justice Jo Hee-de’s intervention in the presidential election and the request for witnesses to attend at the 5th meeting of the 429th National Assembly (regular session) Judiciary Committee, we aim to contribute to the restoration of the constitutional order.” Rep. Shin added, “The Democratic Party lawmakers, independent Rep. Choi Hyuk-jin, Rebuilding Korea Party Rep. Park Eun-jung, and others who agreed—these individuals will remain in modern Korean history as culprits, recorded for their actions.”
