PDP Convention Halted by Court Order
The Federal High Court in Abuja has reiterated its standing order, instructing all involved parties to maintain the status quo concerning the upcoming National Convention of the Peoples Democratic Party (PDP). The convention is scheduled for November 15 and 16, 2025, in Ibadan, Oyo State.
Justice James Omotosho, the presiding judge, affirmed on Thursday that the court's previous directive remains in full effect. He emphasized that no party should violate this order while the court deliberates on the substantive suit.
Justice Omotosho issued a stern warning, stating that any actions that could potentially undermine the court's authority or render its ultimate decision ineffective would be met with significant penalties. This warning was prompted by a complaint from the PDP's legal counsel, Chief Chris Uche (SAN), who informed the court that his client was bound by the existing order and thus requested an expedited hearing of the case.
The judge responded by assuring all parties involved that a judgment would be delivered before the end of October. He also made it clear that no party would be allowed to employ delaying tactics in the proceedings.
“As legal professionals and officers of the court, we are all aware that once a suit has been filed and the relevant parties have been duly served, the established legal principle dictates that no further action should be taken regarding the subject matter of the suit. The court's authority must be respected," Omotosho stated.
He further elaborated, “Should any party violate this fundamental principle, the court reserves the power to issue consequential orders that would nullify such actions. It is in our collective interest to uphold the law. I assure you that judgment will be delivered before the end of October, and copies will be made available to all parties immediately.”
The court has scheduled Monday, October 20, for a definitive hearing of the originating summons. This summons was filed by three aggrieved PDP members against the Independent National Electoral Commission (INEC) and eight other defendants.
The plaintiffs in the case are Austin Nwachukwu (Imo PDP Chairman), Amah Abraham Nnanna (Abia PDP Chairman), and Turnah George (PDP Secretary, South-South). They are seeking a court order to prevent the party's planned national convention, arguing that the election of new national officers at the convention would be illegitimate.
The defendants named in the suit include:
- INEC
- The PDP
- Senator Samuel Anyanwu (National Secretary)
- Umar Bature (National Organising Secretary)
- The National Working Committee (NWC)
- The National Executive Committee of the party
During the previous court session, Umar Damagum, Ali Odefa, and Emmanuel Ogidi were added as the 7th to 9th defendants, following a successful application for joinder.
The lawsuit, marked FHC/ABJ/CS/2120/2025, sees the plaintiffs requesting declarations and injunctive orders. These orders are aimed at compelling the PDP to strictly adhere to democratic principles in the conduct of its congresses, conventions, and internal elections.
The plaintiffs argue that the party failed to conduct the necessary congresses to elect delegates for the planned convention. They claim this failure invalidates any notice issued to INEC regarding the convention.
Furthermore, the plaintiffs are asking the court to restrain INEC from recognizing or giving effect to any notice or outcome of the PDP convention. They argue that the convention must be conducted in full compliance with the 1999 Constitution (as amended), the Electoral Act 2022, and INEC’s 2022 Regulations and Guidelines for Political Parties.
Additionally, they are seeking orders to prevent the PDP and its officials from holding any National Executive Committee, National Caucus, or Working Committee meetings without proper notice from the National Secretary.
Justice Omotosho has instructed all parties to exchange their legal documents and processes by October 17 to ensure a smooth and efficient hearing.
During Thursday’s court session, the PDP was represented by Chief Chris Uche (SAN) and the party’s National Legal Adviser, Kamaldeen Ajibade (SAN). However, the judge directed both lawyers to file formal documentation to allow the court to determine the party’s proper legal representation in the case.
